AGREEMENT AND RELEASE OF LIABILITY

ONSITE STUDENTS

In consideration of being permitted to attend the Nitartha Summer Institute teachings on site at Lewis & Clark College, I agree as follows:

I agree to release the Nitartha Institute including its officers, directors, employees, sub-contractors, sponsors, agents and affiliates from all present and future claims, demands, damages and actions or suits that may be made by me, my family, estate, heirs, or assigns for any and all property damage, personal injury, or wrongful death as a result of or in any way related to my participation in the 2024 Summer Institute wherever, whenever, or however the same may occur.

I understand and agree that Nitartha Institute is not responsible for any injury or property damage arising out of my participation in any of the Summer Institute’s activities, even if caused by their ordinary negligence or otherwise.

I understand that participation in any program involves certain risks, including, but not limited to, serious injury and death. I am participating in the activities with knowledge of the danger involved and I agree to accept all risks of participation.

I also agree to indemnify and hold harmless Nitartha Institute for all claims arising out of my participation in any of the activities this summer.

Lujong and/or yogic exercises: If I participate in lujong and/or yogic exercises, I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in those activities.

I understand that the highly contagious nature of COVID-19, and the fact that individuals infected with COVID-19 may be asymptomatic, creates a risk of infection from any activity involving contact with others. I understand and acknowledge that I am responsible for reviewing Nitartha Institute’s health and safety protocols for the Summer Institute and ensuring that I follow those protocols.  I voluntarily assume the risk that I may be exposed to or infected by COVID-19 while attending the Summer Institute. I understand that the Nitartha Institute may exclude me from the 2024 Summer Institute in the event that I fail to abide by the Nitartha Institute’s or Lewis & Clark College’s health and safety protocols, disrupt, impede or interfere with the operations of the 2024 Summer Institute, or threaten the health, safety or welfare of other participants or Summer Institute staff, and that no refund of any fees will be made in such circumstances.

I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.

I also acknowledge that Nitartha Institute has not arranged and does not carry any insurance of any kind for my benefit or that of my parents, guardians, trustees, heirs, executors, administrators, successors, and assigns.

I also understand that this document is a contract that grants certain rights to and eliminates the liability of Nitartha Institute.

Nitartha Institute’s staff members do everything they can to keep the program and premises safe and comfortable for visitors and staff members. We encourage you always to inform us of anything you see that requires attention.

HAVING CONSIDERED THE ABOVE, AND AS MY SHARE IN SUPPORTING NI, I FREELY ACCEPT AND VOLUNTARILY ASSUME THE RISKS OF INJURY AND RELEASE NI AND THEIR STAFF, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM THE NEGLIGENT CONDITIONS OF THE PREMISES, OPERATIONS OF NI AND FROM THE ACTS OR OMMISSIONS OF NI STAFF OR FROM RESPONSIBILITY FOR ANY SUCH DAMAGE OR INJURY OF ANY KIND THAT MAY RESULT. I MAKE THIS WAIVER FOR ANY PART OF THE NI PROGRAM IN WHICH I MAY PARTICIPATE, AND I INSIST THAT MY WAIVER COVER ANY CLAIM THAT MY SUCCESSORS, HEIRS OR ASSIGNS MAY HAVE, INCLUDING BUT NOT LIMITED TO MY SPOUSE AND/OR CHILDREN.

ONLINE STUDENTS

In consideration of being allowed online access to the Nitartha Summer Institute teachings, I agree as follows:

I understand that under no circumstances will Nitartha Institute be liable in any way for any   loss or damage of any kind incurred as a result of the use of, access to, or denial of access to the online courses. I understand that Nitartha may delete any content, or remove you from a session in progress, at any time without notice to you, if Nitartha becomes aware that the content I transmitted violates any provision of the Summer Institute 2024 Ethical Conduct Agreement, or any law.

I will not transmit any content or use any chat function except as permitted in connection with the classes I am taking.

I agree not to use Nitartha’s 2024 Online Summer Institute Services to communicate any message or material that is harassing, libelous, threatening, obscene, indecent, would violate the intellectual property rights of any party or is otherwise unlawful, that would give rise to civil liability, or that constitutes or encourages conduct that could constitute a criminal offense, under any applicable law or regulation.

I understand that if my video is on, others may see me. I further agree that NI is not liable for any reaction I or others may have as a result of my being seen online.

I understand that NI cannot control the actions and video screens of others online, and I agree that NI is not liable for any upset or cause of action I may have as a result of what I may see online.
